I wanted to check if this is the same covenant that everyone else has:
Many thanks,AND WHEREAS the registered proprietors wish to create certain restrictive covenants as between the said Lots comprised in the said land to the intent that each of the said Lots shall henceforth always have both the benefit and the burden of the said restrictive covenants as hereinafter set forth
NOW THEREFORE in consideration of the premises the registered proprietors DO HEREBY TRANSFER their respective estates and interests in the said land to themselves the registered proprietors AND DO HEREBY COVENANT with themselves as registered proprietors of the said land that henceforth all the Lots comprising the said land shall have the benefit of the restrictive covenants which follow in the numbered paragraphs below in favour of each individual Lot over all the other said Lots and shall have the burden of the same restrictive covenants which follow as aforesaid in respect of each individual Lot in favour of all the others of the said Lots such restrictive covenants being as follows:-
1. That there will not at any time hereafter be erected nor permitted to be erected on any Lot as aforesaid any building except one private dwelling or two private single residential units with garage(s) and/or carport(s).
2. That there will not at any time hereafter be commenced nor permitted to be commenced on any Lot aforesaid the erection of any dwelling or residential unit or other work without the plans, site plans and specifications therefore having beforehand been submitted to and having been given written approval by the registered proprietors, provided that such consent shall not be unreasonably or arbitrarily withheld.
3. That in the construction of any dwelling or residential unit or other work on any Lot as aforesaid they will not be altered nor deviated from nor permitted to be deviated from to any significant degree in any such case any plans, site plans and specifications relating thereto to which the registered proprietors may have given written approval as provided in the preceding paragraph 2 hereof without the written approval of the registered proprietors to any such change having beforehand been given.
4. That except while building operations are in progress there will not at any time hereafter be placed nor permitted or allowed to be brought on to or remain on any Lot as aforesaid any temporary dwelling, caravan, trade vehicle, trade equipment or materials, debris, rubbish or vehicle of an unsightly nature unless the same is adequately garaged or screened to prevent offence to any adjoining property and to preserve the amenities of the neighbourhood.
